First town to deal with its illegal houses under the Regularization Decree (2/2012) runs into difficulty as 14 out of 17 proposed urban settlements rejected by the Regional Government

In March 2012 the provincial town of Albox (pop. 11,000) became the first in Andalucía to approve a draft plan (Avance) describing how it proposed to deal with some 2,500 illegal houses within its territory under the terms of the Regularization Decree 2/2012.

The town’s Mayor, Jose Garcia (PSOE), said at that time that he believed that 99% of these houses were legalizable.

Today, we learn that 14 of the 17 urban settlements proposed within this draft plan have been rejected by the regional government.

An examination of the Inspection plan which accompanied the draft plan also reveals that some 295 properties are considered to be on protected land or incomplete, placing them at risk of prosecution.

A further, 278 properties are found to be on land that was, allegedly, illegally segregated into building plots, in many cases using permissions provided by the town council. The owners of these properties may be forced to surrender their individual land deeds and enter into joint land ownership arrangements.

A spokesperson for AUAN said “It’s a farce. The regional government is totally out of touch with reality and the problems faced by homeowners, our towns and the property market. The decree is a pedantic, bureaucratic and expensive sticking plaster which is all spin and no solution”.
