NEW LEGISLATION TO STRENGTHEN THE ROLE OF CHAMBERS OF COMMERCE

The government has approved, for submission to Parliament, the Basic Draft Law on Official Chambers of Commerce, Industry, Services and Navigation. The new legislation aims to strengthen the role of Chambers of Commerce as instruments for the inter nationalisation of Spanish companies in partnership with the central government and the autonomous regions.

The Vice-President, Soraya Sáenz de Santamaría, stressed that “the new legislation responds to the widespread demands of the sector to promote a regulatory framework that provides the Chambers of Commerce with clarity and legal certainty”.

The new legislation will define the functions of the Chambers of Commerce in key sectors for the economy, it will enhance their role in dual vocational training, providing them with mechanisms similar to those of other chambers to combat youth unemployment, and will increase their role in mediation and arbitration in commercial conflicts.

Soraya Sáenz de Santamaría also pointed out that the Chamber of Commerce of Spain will replace the current Higher Council of Chambers and will become the representative body for all of them. “What we are seeking is coordination and an improvement in the operation of the institutional and trade presence of Spain overseas through this new body”, she added.

Finally she highlighted that among the new features the activities of a private nature will be differentiated with greater clarity from those of a public nature, the text will incorporate the obligation of the Chambers of Commerce to draw up a code of good practices that guarantee transparency and increase the representative nature of the organisations of the autonomous regions. The new legislation also establishes the obligation of publishing the remuneration of those holding high office and removes the obligation of incorporating one chamber per province.
