The trial against one of the most famous businessmen in Orihuela, Ángel Fenoll, along with 17 other people including a former Albatera PP councillor Francisco Javier Bru, for offenses against the Treasury and forgery of commercial documents began on Thursday after a two day suspension due to the failure of one of the defendants to attend court.

On Tuesday, at the request of the Prosecutor, Pablo Romero, the judge ordered the immediate search and arrest of Manuel López Poveda, in order to guarantee his appearance at the trial postponed until Thursday.

The Prosecutor is demanding 36 years imprisonment for the main defendant, Ángel Fenoll, for 11 offenses against the Treasury and a continuing offense of falsification of a commercial document, in a case relating to tax evasion worth in the region of 4 million euro.

According to the letter from the prosecutor, false invoices were filed “in order to hide the true result of the activity” of the two companies, Colsur and Proambiente, and “defraud the Treasury” by avoiding paying corporate tax and for the years 2002, 2003 and 2004.

Fenoll was sentenced to prison in 2007, with 300,000 euro bail, as part of the now infamous “Brugal” case, which is linked to a number of members of Orihuela´s Partido Popular, including former Mayor, Mónica Lorente. A witness testament in a court hearing in 2007 stated that Fenoll played a “decisive part” in the municipal campaign that led to Monica Lorente becoming mayor of Orihuela in 2007.

During the previous administration of the PP government in 2011, spokesperson for the liberal CLR group, Pedro Mancebo, was also vocal in criticising the relationship between the town hall and Fenoll, asking “What power does this entrepreneur have in our City?”, whilst accusing the then government team, with whom he has now sided in opposition, of yielding to pressures from Fenoll to pay off 5 million euro in debts, questioning why a payment plan was agreed with Fenoll, “when other entrepreneurs have to wait years” in order to collect their debts, whilst Fenoll is free to meet with the Mayor, and seemingly had “free entry into the City to negotiate”.

The court adjourned the hearing on Thursday, resuming on Monday, after Fenoll´S lawyer, José Celestino, asked for a large amount of evidence to be dismissed, on account of administration anomalies. The defence also state that the large proportion of companies cited in the case did not have sufficient time to prepare their accounts, and so that evidence should also be inadmissible. The judge will decide on the appropriate course of action upon resumption of the trial.

According to the considerations of the prosecution, the false invoices were “entirely made up by the other defendants” with them documenting the provision of services or delivery of goods “for the Colsur and Proambiente entities that had not been made”, and that Fenoll “facilitated” the issuing of the documents in order to avoid payment.
