Bungalows awaiting demolition in Tabarca

The Supreme Court has denied compensation for the demolition of properties on the island of Tabarca because it hasn’t yet been carried out.

The Superior Court of Valencia (TSJ) denied the right of compensation to the owners of the bungalows which were erected 20 years ago on protected land, at least until they have been demolished, the judgement says.

But despite the eviction of the occupants early last year, the Supreme Court is now voicing their doubts that demolition will ever take place. Because of changes to the law which have been introduced since the demolition order was originally made by the Supreme Court (SC) in 2009

The owners say they are claiming “damages for injuries related to the judicial ruling that cancelled their license of occupation. They say they have also lost income as a result of previously anticipated rental and holiday bookings that have been lost since the judgment was made.

Now, in a judgment made in December 2014, which was released last week, the Supreme Court have partially rejected the appeal filed by the owners against a decision of the Department of Infrastructure, Planning and Environment stating that they can not claim compensation for damage that has not yet occurred.

The properties are located at the junction of la cala Birros and according to the Department of Infrastructure, Planning and Environment they were illegally built in an area within the boundaries of one of Tabarca’s protected areas.
