Court Denies Toll Compensation

The Supreme Court has rejected an appeal filed by toll road operator AUSUR against the Ministry of Development for 315 million euro compensation.

The complaint was lodged when the concessionaire considered that by doubling the width of the N-332 coast road between Guardamar and Cartagena, excluding the section at Torrevieja, would result in a loss of earnings for the toll road operator.

The company therefore filed for loss of earning between 2009 and 2048, when the concession contract ends, totalling 315 million euro.

However, the court rejected the claim as the loss of traffic was a foreseeable risk when the company participated in the tender process for the operation.
