British Man Acquitted After Year on Remand
A British man facing 11 years in prison has been acquitted by the Provincial after spending a year behind bars on remind on a charge of rape on the Orihuela Costa.
The incident occurred in November, 2012, when the man met with a woman in a bar on the Orihuela Costa. The couple then left to go to a private property to engage in a sexual act. According to the ruling, this sexual activity was consensual.
The judge said that the victim’s statement was full of contradictions, having expressed different things each time. The court also noted that even the forensic experts told a different story of what happened.
The statements varied from the victim sleeping at the time of the alleged assault and the fact that the sex was consensual but led to violation when anal intercourse was attempted.
The defendant was facing 11 year in prison but contradictions from the alleged victim and the absence of evidential injuries have led to the case being dismissed.
