How to avoid the pitfalls and what to do if you get caught

Whilst many British homeowners enjoy life in Spain it is important to note that a large number of people who bought properties here now face serious problems with their homes.

According to information published by the regional government (Junta de Andalucía) there are approximately 300,000 illegal properties in Andalucía, with some 12,697 in the Almanzora Valley alone.

Do you think that you may already own an ‘illegal’ property?
If you think that you may have purchased an illegal property, then you are not alone. Various associations exist to offer support and factual, independent advice.

In Almeria, we have AUAN (Abusos Urbanisticos Almanzora No), a non-profit, non-political organisation consisting of homeowners who campaign to bring about the legalisation, where possible, of homes that are currently considered to be ‘illegal’ under the present planning laws of Andalucía.

We have just one aim, and that is to bring about the changes required to improve the situation of those who inadvertently purchased an ‘illegal’ home. We do this through:

 Collective representation to local Councils, and Regional and National Government.
 Representation to the UK Government and the European Parliament.
 Promoting self-help by informing members of developments and changes to present legislation, town plans etc. We do this using the services of professional, independent advisors.

All activities are funded through our membership fees.

Positive action brings results
Working with other associations we have already persuaded the regional government to give a form of legal recognition to some illegal properties but much remains to be done.

We are a currently supporting a case to the European Court of Human Rights and continue to support other forms of legal action that ultimately may benefit everyone.
