The First Section of the Provincial Court of the Balearic Islands will begin to hear evidence from today, Tuesday, against a man who is accused of repeatedly raping his stepdaughter, taking advantage of the fact that they lived together in Mahón (Menorca), for which the prosecutor requests 21 and a half years in prison.
The events occurred between 2018 and 2019, when the girl was then 12 and 13 years old. According to the prosecutor, during those years, the defendant lived with his partner and her two minor children, including the victim.
Thus, taking advantage of the fact that due to his status as stepfather he could be left alone with the children without raising suspicions, he subjected the minor to conduct of a sexual nature.
Specifically, the prosecutor details that on one of the occasions, arriving home drunk, he entered the girl’s room and touched her breasts and genitals, despite her resistance. At another time, again in a drunken state, he approached the girl in her bedroom and touched her, in this case she succeeded in getting him to stop by kicking him several times. Also, at the end of September 2019, he was also drunk, he approached her for the third time.
The Prosecutor’s Office also maintains that the events were witnessed by the victim’s brother, who was then 6 and 7 years old. As a consequence, both have suffered traumas.
For all of the above, the prosecutor requests for the man, for each crime of sexual assault, eight and a half years in prison, probation for a period of seven years, special disqualification from working with minors for a time of 12 years and a ban on approaching or communicating with children for another 12 years.
In addition, for the crime of sexual abuse, he requests a sentence of four years and six months in jail, six years of probation, disqualification from working with minors for eight years and restraining order and prohibition of communication for nine years.
In any case, the prosecutor is interested that, in case of being convicted and serving three quarters of the sentence or accessing the third degree or probation, the prison sentence be replaced by expulsion from the national territory in a period of less than ten years.
On the other hand, he demands that he compensate the legal representatives of the girl in the amount of 18,000 euro and of his brother in the amount of 5,000.
