Many workers in Spain are about to take summer holidays, whilst many others start to work in order to cover the increase in demand, and it is worth noting that although all workers have the right to enjoy vacations during the year, many are unaware that there are a few occasions where you are entitled to additional days off, without affecting your salary.

Labour legislation determines a minimum of 30 business days per year worked for vacations. Of course, it will need to be a full day. For each month worked, the worker is given 2.5 days of rest. They can enjoy them in a monthly payment, fortnightly or as agreed between the employer and the employee. Regardless of the option chosen, at no time will your payroll be affected.

In this sense, it must be clarified that there can always be variations depending on the sector and the collective agreement that is applied. But, in general, this vacation period lasts for almost a month.

To this will be added throughout the year the different holidays. They can be national, such as New Year’s Day, Three Kings Day (January 6) or Labour Day (May 1). In addition, each town hall and autonomous community has the capacity to decide other festivities.

There are also other occasions where you are entitled to time off:

  • Death, hospitalisation, accident or surgical intervention of a relative who requires rest at home. In this case, you can claim two days off, which could be increased to four if they had to travel to another community.
  • Marriage: the worker will have 15 paid days off after getting married.
  • Moving home: the change of address will mean an extra day of rest to facilitate your transfer.
  • Paternity or maternity leave: for this, it will be necessary to prove attendance at prepartum preparations or prenatal exams. The time necessary to attend to all those inexcusable tasks of a public nature will also be provided. Employees may be absent one hour from work for lactation of a child under 9 months.
  • Training: a worker will be entitled to up to 20 hours per year to participate in training courses. It is necessary that they maintain a certain link with the position they hold. They also have paid days off when they have to attend exams to obtain an academic title. The period of absence will appear in the agreement or will be dealt with individually between the employer and the employee.
  • Jury duty: When it is time to perform jury functions in a trial.
  • Union representation: Union representatives or people who negotiate collective agreements will have justification for missing their post.

What happens if vacations are not spent in the current year

It is possible that for reasons of production or company needs, that a worker does not enjoy all of their vacation days. That won’t make you lose them. Usually, companies allow them to be taken during the following year.

They would accumulate to those corresponding to the following financial year, although in some cases they require that they be spent during the first quarter. In any case, before carrying out any procedure, it would be necessary to consult the human resources department. They will inform you correctly, since in each company the operation is different.
