Man faces 15 years in prison for setting fire to his mother’s home

The Second Section of the Provincial Court in Albacete will begin to hear evidence from today against a man who faces 15 years and five months in prison for setting fire to his mother’s house, putting the lives of his neighbours at risk.

Specifically, the Prosecutor’s Office considers him guilty of a crime of arson with danger to the physical integrity of people, two continuous crimes of threats and another crime of threats. The Prosecutor’s Office also requests that he compensate his mother with 16,378 euro for the damage he caused to her home and the neighbours for the damage caused to the building.

According to the prosecutor’s indictment, the events took place around 11 p.m. on July 2, 2022, when the defendant, BGT, with non-computable records, was at the home where he lives with his mother, MTG, a home that is owned by his mother and is located in the city of Albacete.

The accused, acting with the intention that the fire would spread to the rest of the homes in the block, knowing that they were inhabited and with conscious disregard for the lives of their inhabitants, doused the sofa with petrol in the living room and set it on fire, and once he confirmed that it was burning, he left the house, deliberately breaking the lock from the inside, leaving the broken key inside, to prevent the passage of the firefighters, who had to break the door down to access the interior and put out the fire.

The accused thus carried out the threats that, on many occasions during the previous three years, he had made to both the neighbours and his own mother, to burn the property and make it explode.

The agents of the National Police and the fire fighters who went to the scene were forced to evacuate all the residents of the building, given the imminent danger to their lives and physical integrity, who, to prevent the fire from spreading to the other floors, since the flames were coming out of the windows, were forced to break into the door of the house.

The house was completely affected by the fire and the smoke from the fire, damaging the electrical installation, walls, ceilings, wooden carpentry, PVC carpentry and all of the furniture, despite the quick action of the firefighters, who were alerted by agents of the Local Police, when they noticed the column of smoke coming out of the door when they were patrolling the area.

The home suffered damages valued at 16,378 euro, which are claimed by the owner. The president of the neighbourhood association also claims for the damage caused to the building, which has not been assessed.

The accused, who lived with his mother in the property described, had told his mother on many occasions prior to the events that he would kill her, causing the woman a climate of continuous terror.

Around 2:30 p.m. on September 9, 2022, the accused went to his sister’s house, also located in Albacete, where he knocked on the window and when she looked out, with the intention of intimidating her, he showed her a kitchen knife of 20 centimetres told her: “I’m going to kill you”, then leaving.

According to the defence, the accused, at the time of the events, had a disorder due to the use of amphetamines and alcohol and paranoid schizophrenia that altered his cognitive and intellectual faculties, in such a way that, having been able to understand the illegality of the events, he would have had difficulties controlling the impulse and to act in accordance with that understanding.
