Flavoured heated tobacco products banned

The Council of Ministers approved this Tuesday the Royal Decree that regulates certain aspects related to the manufacture, presentation and marketing of tobacco and related products.

In such a way that the sale of heated tobacco that contains aromas is prohibited and the labelling is required to include warnings that it is harmful to health, assigning those products that can still be sold with traditional smoking items such as cigarettes.

The prohibition applies to marketing tobacco products with a characteristic aroma or that contain flavourings in their components (such as filters, smoking papers, containers or capsules), or any other technique that allows modifying the smell, flavour of tobacco products, or intensifying the smoke from heated tobacco products. In addition, filters, papers and capsules may not contain tobacco or nicotine.

The exception to the obligations to include an informative message and combined health warnings is withdrawn. Therefore, the packaging units and outer packaging of heated tobacco products must include:

The following informative message: “Tobacco smoke contains more than 70 carcinogenic substances.”

The colour photographs specified in the image library of Annex II of Royal Decree 579/2017, of June 9.

The Government thus transposes the Delegated Directive, of June 9, which modifies Directive 2014/40/EU with regard to the withdrawal of certain exceptions applicable to heated tobacco products, in order to make it comparable to conventional cigarettes.

This Royal Decree will come into force within three months from its publication in the BOE.

The regulation only affects heated tobacco products and not all vaping devices (yet).
