The Granada Court has confirmed the sentence of eight months in prison for a man accused of defrauding another in the purchase and sale of a video game console through the Wallapop platform, facts for which he will also have to compensate the injured party.
As stated in the ruling, the accused offered a Playstation 5 video game console for sale on this platform in May of 2022, pretending that he had it in his possession.
The victim became interested in the purchase and contacted him through the phone number he put on the website and they agreed that he would make a transfer of 589.95 euro to his account. The defendant seized the money but never sent him the console “nor has he justified” at any time that he had it in his possession to sell it.
The victim reported the matter and the Criminal Court 1 of Granada sentenced the accused as the perpetrator of a crime of fraud to eight months in prison and to compensate the injured party in the 589.95 euro that he gave him, but the alleged fraudster appealed the sentence.
Thus, and although he acknowledged before the Police and the court that he had opened an account to receive the money from this scam, he assured that he did so at the request of a third person who would have been the material author of it.
However, the Provincial Court emphasises that the documentation contained in the proceedings proves that he opened the aforementioned bank account and also his participation in this scam, “at least as a necessary cooperator”, since he collected the money even if it had been for a third party.
These are all reasons why the accused’s appeal is rejected and the sentence imposed by the Criminal Court is fully confirmed.
