New sick leave rules from 1 April

As of April 1, a new rule for sick leave comes into force, as published by the Secretary of State for Social Security and Pensions, as it will no longer be necessary for the worker to deliver the sick note to the company.

The physician who issues the medical leave, confirmation or discharge will give the worker only one copy of it and it will not be necessary for the worker to have to transfer a copy to the company, who will now be able to download it from the Fichero INSS Empresas.

From April 1, the Public Health Service, mutual or collaborating company will send the data contained in the medical reports to the National Institute of Social Security (INSS) by electronic means.

Once this information is received, companies will be able to consult the data through the Fichero INSS Empresas, the official companies portal. When the company or employer does not have the obligation to join the RED System, communications will be made by ordinary mail and by SMS. This information will also be available at the electronic headquarters of the Social Security.

For their part, companies have the obligation to submit to the INSS, within a maximum period of three business days and through the RED System, the economic data of the medical leave. Thus, companies will no longer have to transmit to the INSS the economic data contained in the confirmation and registration parts, also simplifying these processes.

The objective is to facilitate and expedite the work of doctors with regard to the management of the reports, since the INSS will not require the completion of the National Occupational Classification (CNO) by the doctor, which It means a decrease in the workload they assume, since they will become voluntary.

In addition, as of April, the companies will now be responsible for completing the information on the functional activity carried out by the worker, that is, both the completion of the CNO and a description of the functions performed by the worker and the detail of their job and position.
