The Third Section of the Provincial Court of Alicante has confirmed the ten-month prison sentence imposed by a Criminal Court on a man for a crime against privacy, for having shown two of his friends a video of his sexual relations with a woman.
The Provincial Court has thus dismissed the criminal’s appeal against the ruling handed down in the first instance, which also obliges him to compensate the victim with 700 euro for the damages caused.
The events occurred on November 13, 2020, when the defendant and a woman had consensual sexual relations that he recorded with her consent inside his home, located in the town of San Vicente del Raspeig.
A few days later, without the consent of the victim, the man showed the images to a friend of his with whom he was partying. That friend came to partially reproduce the video and thus verbally acknowledged the victim herself. The defendant also showed the same recording later to another friend.
The Court has now issued an appeal ruling that confirms the one issued by a criminal court in Alicante, understanding that the latter contains a “logical and rational” assessment of the evidence practiced in the trial, such as the statements of the witnesses.
The Court highlights in the resolution that, although the defendant did not carry out a “public distribution” of the intimate images, he revealed them to third parties without the consent of the complainant, “seriously undermining her personal privacy”, therefore the facts constitute a crime of article 197.7 of the Penal Code.
