The Administrative Chamber of the Supreme Court will consider the appeal submitted by María del Carmen García, after she was refused a governmental pardon for killing the rapist of her daughter.
The rape occurred in 1998, when the daughter was just 13, with María del Carmen García having entered prison on the 8th of May, after she was found guilty of setting a man on fire, resulting in his death. After appeals since her conviction, a prison term of five years and six months was to be served for her crime.
Her legal team have been trying to prevent her incarceration on medical grounds, but have so far been unsuccessful. The latest appeal failed after it was decided that the reason for her taking the action she did does not diminish the fact that she carried out an attack which resulted in her victim´s death, contrary to law.
Having failed in her appeal with the Council of Ministers, this court appeal was ongoing, with the court expected to rule on the findings of the case within days.
The legal team are still asking for the sentence to be suspended, arguing that imprisonment would be “plainly destabilizing” for the “mental and physical state” of María del Carmen García, because of her “serious mental illness” which , according to counsel, is “incurable”.
