The trial begins today, Wednesday, in the Provincial Court of Almería, against a man for whom the Prosecutor’s Office is asking for eleven years in prison, as he is accused of ending the life of his roommate in the residence for people with disabilities in Viator (Almería).
The man is accused of a crime of homicide with the mitigation of mental alteration, understanding that at the time the events occurred he suffered from a mild intellectual disability although his intellectual and volitional abilities were altered, not annulled, according to the Public Prosecutor’s Office in his indictment.
The events took place around 8:00 a.m. on September 12, 2021, when the man, with a recognised degree of disability of 68 percent, was in the residence and found his roommate in one of the corridors, with which he allegedly engaged in “a strong discussion”.
According to the indications, the man delivered a “strong punch to the face” that caused the victim to lose his balance and collapse on the ground, a moment that he would have taken advantage of to continue with the aggression on the victim, who was lying face down and “motionless” in the corridor.
It was then that, in a “surprising” manner, the defendant hit the head of the victim again, resulting in the loss of consciousness and from which he suffered significant injuries to the skull for which he was taken by ambulance to the Torrecárdenas University Hospital where he died nine days after the assault.
The trial, which contemplates its development in three sessions from April 12 with the testimony of witnesses and the practice of expert evidence, will take place in the Second Section of the Provincial Court of Almería.
