The Prosecutor’s Office of the Principality of Asturias will hear evidence from today against a lawyer from Oviedo accused of seizing more than 8,000 euro from various clients.
The Public Prosecutor maintains that, throughout the years 2019, 2020 and 2021, the defendant, in his capacity as a lawyer of the Oviedo Bar Association, with an office in Oviedo, was hired by various people to carry out different procedures, the most related to procedures for obtaining Spanish nationality or residence, and seized the amounts that his clients gave him without carrying out any diligence in the defence of interests.
The total amount supposedly appropriated amounts to 8,339.5 euro, according to the letter from the Prosecutor’s Office.
The Prosecutor’s Office considers that the facts constitute a continuous crime of misappropriation in ideal competition with a continuous crime of professional disloyalty and requests that the defendant be sentenced to 2 years in prison and special disqualification for the right to passive suffrage during the time of the conviction for the continued crime of misappropriation and a fine of 22 months, with a daily fee of 10 euro and subsidiary personal liability in case of non-payment, and special disqualification for employment, public office and to practice his profession as a lawyer for 3 years, for the crime of professional disloyalty.
In terms of civil liability, the Public Prosecutor requests that the defendant pay the corresponding compensation to the injured parties, plus the corresponding legal interest.
