The Second Section of the Provincial Court of the Balearic Islands will begin to hear evidence from today, Thursday, in the trial against a man accused of mistreating his partner and sexually assaulting her, forcing her to perform sex acts with violence.
The Public Ministry points out in its brief that on March 10, 2020, around 9:30 p.m., the defendant assaulted his partner at their common home in Palma, pulling her hair, violently, headbutting her, punching her several times, and kneeing her in the groin area.
According to the Prosecutor’s Office, these attacks caused the victim intense pain, a bruise on the head and trauma to the genitalia, for which she required medical assistance and seven days to heal.
For these reasons, the Investigating Court number 11 of Palma, acting as a guard, issued a protection order in favour of the victim on March 11, 2020.
In addition, prior to these events, in March 2019, the defendant already forced the victim to perform sex acts on other occasions, grabbing her head with force and bringing her closer to his genitals against her will.
According to the prosecutor, this sexual assault was motivated by a libidinous spirit and an attempt against the sexual freedom of others, using his position of dominance and as revenge for the new relationship that the victim had started with another person.
The Prosecutor’s Office considers these facts constituting a continued crime of sexual assault and one of ill-treatment with aggravating circumstances of gender and kinship, and requests 13 years in prison for the man, five of probation and the prohibition to approach the victim less than 500 metres away, as well as communicating with her for 18 years.
Likewise, it requests that the defendant compensate the victim with 500 euro for the injuries suffered and 20,000 euro for moral damages as a consequence of the continued crime of sexual assault.
