The Fifth Section of the Provincial Court of Valencia will begin to hear evidence from today, Wednesday, against a man and a woman accused of having defrauded 42,995 euro from a company interested in the purchase of nitrile gloves in May 2020, in the midst of the covid pandemic.
As detailed by the prosecutor in his indictment, both are accused of a crime of falsification of a commercial document in a medial competition with a crime of fraud.
The Public Ministry demands for both one year and three months in prison for the crime of forgery and two years and six months for fraud, in addition to a fine of 2,700 euro and the return of the aforementioned amount, plus legal interest.
The accused are a man and a woman who, “guided by the desire to benefit at the expense of others, feigning experience and commercial solvency that they lacked and simulating a commercial representation that they did not have,” according to the prosecutor, arranged the sale of 10,000 boxes of nitrile gloves manufactured and imported from Thailand.
The final agreed price was 85,910 euro, provided that half of the price was paid in advance.
For this operation, the defendants allegedly prepared and delivered to the complainant an invoice dated May 16, 2020, which they prepared pretending that it had been issued by the alleged supplier firm and in which a bank account number was recorded that, in reality, It belonged to one of the accused.
The victim, in his false belief that the invoice was legal, paid 42,995 euro into the aforementioned account without any merchandise being delivered.
