The Prosecutor’s Office has requested 2 years and 9 months in prison for a man who hit a couple of girls with his crutches and in another case, 2 years and 11 months in prison for two young girls who attacked a minor on two occasions.
The second section of the Provincial Court of Madrid will judge both homophobic attacks this week, as appears in the accusation documents of the Public Ministry.
On Monday, the trial began against a 57-year-old man who “moved by his prejudices against people because of their sexual orientation” hit his neighbours with his crutch, whom he had already addressed at different times in a derogatory manner when he crossed paths with them.
According to the prosecutor’s provisional conclusions, the events occurred around 6:30 p.m. on April 2, 2020, next to the portal of the building where they lived in Madrid.
The couple reproached the accused for having urinated in the communal areas and, in response, “guided by his prejudices” and in the presence of other neighbours, he shouted at them “with evident offensive and contempt” various insults and threats. After which the accused proceeded to hit them with his crutch.
As a result of the attack, one of the affected girls suffered injuries to the neck, side and other areas of the body, in addition to an anxiety crisis. While her partner suffered a head injury and another to the forearm.
After these events, the accused left three handwritten notes on the window of one of the victims’ vehicles in which he continued to threaten them with the “same contempt for their sexual orientation.”
The Prosecutor’s Office is asking for two years and six months in prison for this man, in addition to a fine of 2,520 euro for crimes against dignity, threats and injuries. As civil liability, he must also pay 1,200 euro to each of them.
The second trial began yesterday against two women, ages 23 and 25, who attacked a 17-year-old transsexual boy on two occasions.
The first attack occurred on June 18, 2020, when the two accused “in common agreement and moved with obvious contempt for his sexual identity” approached the minor on a street in Madrid and gave him numerous blows that took more than one month to heal.
4 months later, around 9:00 p.m. at night, the two young women, along with other people who have not been identified, approached the victim and his partner to “frighten” them. They uttered insults about their sexual identity, threatened to kill them, and hit the minor again for the second time.
The prosecutor states that there is no evidence that they inflicted blows on the other minor and partner of the victim, since she fled to a doorway to take refuge.
The Public Ministry asks the accused for 2 years and 11 months in prison, a fine of 3,060 euro and that they compensate each of the victims with 1,500 euro. They must also pay 3,450 euro to the minor who suffered the injuries.
