Carer on trial for sexually abusing care home residents

The First Section of the Provincial Court of Palma will begin to hear evidence today, Monday, in the trial against a carer in a residency home who, allegedly taking advantage of his professional status, sexually abused and took photos and videos of a sexual nature of two users with recognised mental disabilities.

According to the prosecutor’s brief, during 2018 the man was working for the entity Patronato de la Agrupación Pro-minusválidos psíquicos as a caretaker in the residence, where eight people with disabilities lived.

The monitors were distributed in different morning, afternoon or night shifts, leaving a single monitor in the middle of the afternoon shift, in the night shift and in the weekend shifts.

During the aforementioned period, the two victims, with a recognised mental capacity of 72 and 65 percent, resided in the aforementioned residence during the entire first week and from Monday to Friday of the second.

The defendant, taking advantage of the times he was on duty as the only monitor and the mental pathology suffered by the first victim, touched her chest and genitals, and made her touch herself.

In addition, the prosecutor maintains, with respect to the second injured party, that the man contacted her by WhatsApp and asked her for nude or sexually content photographs and videos. The defendant also sent him photos and videos of him performing a personal sexual act.

Likewise, taking advantage of the moments when he was alone working, he took photos and videos of the victim when she was in the shower or, under the pretext of helping her with her hygiene, when she went to the bathroom. At another time he approached her while she was sleeping and touched her breasts, until the woman woke up and told him to stop.

The Public Ministry considers the facts constituting a continuous crime of sexual abuse with carnal access, another of making pornographic material using disabled people, one of exhibitionism before disabled people and a crime of sexual abuse.

For all these reasons, it requests penalties that add up to 20 years and three months in prison, as well as probation for a period of ten years, disqualification from any profession that involves contact with people with disabilities for six years and restraining orders for 20 years.

The Prosecutor’s Office also requests that he compensate one of the victims in the amount of 20,000 euro and the other with 2,000 euro for the moral damage suffered.
