The Court of Alicante Sentences Two Men to Six Years in Prison for Trafficking Ecstasy and Amphetamines

The Third Section of the Provincial Court of Alicante has imposed sentences of six years and one day in prison and fines of 200,000 euro to two men as perpetrators of a crime against public health for drug trafficking, mainly ecstasy and amphetamines.

The Chamber, on the other hand, has acquitted two other defendants in this case, understanding that their participation in this illegal activity has not been proven.

According to the section on proven facts of the sentence, the two convicted men were arrested in July 2021 in the framework of ‘Operation Pazzo 2’, by officials of the National Police Corps.

The agents carried out various house searches and seized a multitude of pills and wrappers containing MDMA (ecstasy) and speed (amphetamine), as well as small amounts of cocaine, ketamine, and cannabis.

The total amount of the seized drugs would have reached a price of more than 137,000 euro on the black market.

The Court considers that it has been proven that both defendants committed a crime against public health involving substances that cause serious damage to health in quantities of notorious importance.

However, the magistrates have acquitted them of a crime of integration into a criminal group, since they do not appreciate that there was an agreement between them to commit the crime.

Likewise, they also exonerate one of the convicts of a crime of illegal possession of weapons, considering that there is no evidence to prove that he knew that a safe that he kept in his house contained a revolver. The suspects were reportedly squatting in the property at the time of their arrest.

The sentence is not final, since it is possible to appeal against it before the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community (TSJCV).
