The trial begins on Monday in the Civil and Criminal Chamber of the Superior Court of Justice of the Balearic Islands, against the investigators of the Cursach case, Judge Manuel Penalva and the Prosecutor Miguel Ángel Subirán, for whom the Prosecutor’s Office requests 118 and 121 years in prison, respectively.
It is expected that questions will be raised this week in court and then proceedings will be suspended until the trial resumes on June 22 and 23 with the statements of the accused.
In its document of more than 30 pages, the Anti-Corruption Prosecutor’s Office attributes to the magistrate and prosecutor of the investigation phase of the Cursach case crimes of revealing secrets, obstruction of justice, illegal detention, prevarication and inducing false testimony.
The Prosecutor’s Office also requests 162 years of disqualification and a 59,400 euro fine for Penalva and 162 years of disqualification and a 72,600 euro fine for Subirán.
In addition, the Money Laundering Group requests, for crimes of disclosure of secrets, illegal detention, prevarication and obstruction of justice, sentences that add up to more than 340 years in prison.
The prosecutor understands that the accused concurs with the aggravating circumstance of prevailing public character in the crimes of obstruction of justice and in induction to false testimony.
Added to these prison sentences are those presented by the lawyers for Bartolomé Cursach, Bartolomé Sbert, Jaime Lladó and Antonio Bergas. In the letter, they demand penalties of more than 200 years in prison and 338 years of disqualification, and fines that together amount to 2.3 million euro for continued crimes of revealing secrets, obstruction of justice, omission of the duty to prosecute crimes, prevarication, and coercion.
