Local Police officer on trial for accidentally shooting suspect

The Provincial Court of A Coruña will hear evidence this week, starting on Monday, against a Local Police officer accused of “accidentally” injuring a detainee with a firearm. The said detainee is also in court for various offences.

The prosecutor’s document states that the events occurred in the early morning of June 2, 2020, when a suspect was found driving a vehicle without having a driving licence due to loss of all points and under the influence of alcohol.

The Local Police stopped him and instead of stopping he “started to flee” before abandoning the vehicle along with the other companions. Shortly after, they were located by the same agents who stopped them and who pursued them during their escape. Therefore, the accused agent and his partner headed towards the driver and another passenger.

“During this action, either when getting out of the police vehicle or at a later time, but in any case separated by a few seconds, the accused decided to extract and display his service weapon without any act of aggression having been shown to justify the need to do so,” states the Prosecutor’s Office letter.

“Already with the gun in his hand,” the agent approached the driver of the vehicle, who at that moment was leaning facing the wall of the building, with the intention of frisking him and handcuffing him. When he proceeded to do so “with omission of the minimum required diligence,” he rested the gun against the driver’s body and the weapon “was accidentally fired” hitting him at the height of his right arm.

For all this, the driver is charged with the crime of reckless driving, with a crime of driving with the licence withdrawn due to total loss of points, one year and nine months in prison, as well as six months in prison for refusing to take the breathalyser test.

As for the agent, he is accused of a crime of injuries due to serious impudence with the use of a firearm for which he is asked for three months in prison, as well as compensating the other defendant with 4,000 euro for days of healing his injuries, in that of 450 euro for the surgical intervention and 825 euro for the follow up.
