Prison for man who rented out apartment that wasn’t his
The Provincial Court of Valencia has sentenced a man to two years in prison for a continuous crime of fraud for which it includes the aggravating circumstance of recidivism and the mitigating circumstances of a gambling addiction and partial reparation of the damage, after he was found guilty of defrauding 12 people with the rent of a home that was not his.
The sentence, handed down after the Prosecutor’s Office, and to which the defence reached an agreement as the defendant recognised the facts and agreed with the sentence imposed, also condemns him to pay a fine of 1,260 euro.
According to the account of proven facts contained in the resolution, between the months of June and July 2022, the accused, who had already been previously convicted of fraud by a Valencia Criminal Court, offered through a website of advertisements for renting an apartment in Massanassa, even though he was not the owner of it nor did he have any rights over it.
When he made an appointment with the victims, the man showed the house to those interested because his brother, who was unaware of the fraudulent activity, lived there as a tenant.
If there was an agreement, the convicted person signed a contract with the victim, demanding the payment of cash as a deposit to guarantee the rent, amounts that ranged between 450 and 550 euro.
Next, he told the victims that they could not access the property at the moment because it was undergoing construction, and he gave them a new date for entry.
When that moment arrived, the convicted person blocked the injured parties on his mobile phone and did not respond to their calls or messages. In this way he defrauded 12 people.
The sentence, which is final, adds that at the time of the events the fraudster was addicted to gambling, a circumstance for which he voluntarily entered a centre for rehabilitation.
