Child abuse suspect faces expulsion from Spain

The Prosecutor’s Office in Albacete is asking for 20 months in prison for a man for an alleged attempted crime of sexual abuse of a minor, although the prison sentence could be replaced by expulsion from the national territory with a prohibition on returning to Spain for eight years.

The prosecutor is also interested in imposing on the defendant the prohibition of approaching the minor, including her home, study centre, or any other location in which she is or is frequented by the minor at a distance of less than 500 metres and prohibition to communicate with her by any means for five years; in addition to the special disqualification for any profession or trade, whether paid or not that involves regular and direct contact with minors for eight years.

As well as probation for the defendant for four years, which will be executed after the custodial sentence. And, finally, the prosecutor establishes in his brief that the defendant compensate the minor in 3,000 euro for the damages caused.

The indictment of the Prosecutor’s Office cites in its provisional conclusions that the defendant, a 31-year-old national of Morocco, in an irregular situation in Spain, in the month of July 2021, and his wife shared a sublet house with the minor (13 years old at the time), her father and grandmother.

On July 2, 2021, at around 6:25 p.m., when the minor was leaving the bathroom, the defendant “approached” her in the corridor, holding her by the hand, asking if she had “Facebook and WhatsApp”, the minor answered “no, while letting go of the defendant’s hand.” Immediately afterwards, the Prosecutor continues to point out, the defendant “held her hand again, telling her that she was very pretty”, approaching her “to kiss her on the mouth”, without being able to do so, since the minor “withdrew her face and managed to release her hand, running off to her room.
