Postponed rape trial enters court

The fourth section of the Provincial Court of Pontevedra has set Tuesday for a trial for rape which had been postponed since early April. The case, from the Court of First Instance and Instruction Number 1 of A Estrada, is in relation to the alleged rape committed by a man against his ex-partner.

The events being judged occurred in Santiago de Compostela on October 31, 2021, following, according to the indictment of the Prosecutor’s Office, the accused and his victim had maintained a romantic relationship for a few months in 2019.

Two years after breaking off the relationship, the man went with some friends to Santiago, where his ex-partner then resided. The woman, feeling uncomfortable finding him, decided to return to her apartment. When he arrived at the entrance to her building, he met her ex-partner again and they argued. She asked him to leave her, but at his insistence, she allowed him to enter the house. The discussion continued to progress and when she asked him to leave her, he insisted that he was not going to bother her. However, the matter ended in a struggle: him trying to touch her and she trying to prevent him. Finally, the man took advantage of an anxiety attack on the part of the victim, who no longer had the strength to defend herself against him, to penetrate her without her consent.

The prosecutor asks for nine years in prison and six years of supervised release for the aggressor for the crime of rape. Likewise, he requests 17 years of special disqualification for any profession, trade or activity—paid or unpaid—that involves regular and direct contact with minors. In addition, the Prosecutor’s Office demands that the alleged aggressor pay the victim 25,000 euro as civil liability for the moral damages caused.
