Father on trial for multiple abuses

The First Section of the Provincial Court of the Balearic Islands holds the trial from today against a man accused of sexually abusing one of his daughters, a minor; showing pornographic material to his son, also a minor, and for mistreating his three children.

According to the prosecutor’s brief, the defendant lived with his three minor children from 2014 until August 2020 in a home in Ecuador, all of whom were Spanish nationals.

On an undetermined date, around the month of May 2015, when one of the girls was ten years old, while they were at home, the accused proposed that his daughter sleep with him. While the two were in bed, when the minor was beginning to fall asleep, her father allegedly touched her.

After that, the victim got out of bed scared and her father asked her to sleep with him again, telling her not to say anything about what happened or it would happen again.

Likewise, when another of his children was seven or eight years old, the defendant played him a video in which two women were seen undressing and having sexual relations. Again, he told the minor not to tell anyone.

According to the prosecutor, during the time the man lived with his three minor children in Ecuador, he subjected them to seriously humiliating treatment, consisting of insults and even physical attacks such as slaps on the head, blows, etc. in the back, pushing or kicking.

The two minor victims were referred to Utasi for specialised psychological treatment due to the consequences of sexual abuse as a result of these events.

The mother filed a complaint about what happened on August 8, 2020, but the proceedings were provisionally archived due to lack of formal requirements. In September of the same year, the Prosecutor’s Office filed a complaint, leading to the reopening of the proceedings.

The Investigative Court number 3 of Inca agreed to the measure prohibiting the father’s communication or approach to one of his daughters, and measures were issued granting custody to the mother of the three minors.

The facts, according to the accusation, constitute a crime of sexual abuse of a minor under 16 years of age, another of exhibition of pornographic material to a minor and a crime of habitual abuse.

For all of them, the Public Ministry requests penalties that total ten years in prison, the measure of supervised freedom for a period of eight years, the deprivation of parental authority, disqualification from any profession that involves contact with minors for five years and orders of removal for a period exceeding three years of the sentence imposed, if applicable.

Furthermore, in terms of civil liability, it is important to compensate the victims in the total amount of 15,000 euro.
