Following the news that the Valencia head of the PSOE, Ximo Puig, is launching a campaign to have the 1870 law of clemency revoked, judges across Spain have now voiced their opposition to the law that allows convicted corrupt politicians to remain free.
The cause for clemency has made the headlines more recently as the former PP mayor of Torrevieja, Pedro Hernández Mateo, remains free from prison, despite being handed a three year sentence by every level of the judicial and appeals process.
Representatives of the judges have now joined the campaign for the law to be respected, as they say that suspending the entry into prison with firm political convictions as a special offense is wrong, and that, “Given the special consideration of this type of crime, we advocate the elimination of the possibility provided for in Article 4.4 of the Criminal Code to suspend the enforcement of penalties for clemency requests”.
With the judges now backing the change in the law, it may well prove a significant move in the Torrevieja case, with more than double the number of individuals signing a petition that Hernandéz Mateo should go to prison as opposed to those who wanted him to remain free. But with the growing support for criminal politicians to serve their time, it is also of particular interest across the Valencia region where more than 250 such politicians and civil servants are facing such cases.
