Hospital security guard facing 26 years in prison

The Third Section of the Provincial Court of Madrid is hearing evidence against a security guard at the Ramón y Cajal Hospital accused of two sexual assaults on an 18-year-old girl who was admitted to the psychiatric area.

The Madrid Provincial Prosecutor’s Office requests 10 years in prison for him. The representative of the Public Ministry charges him with a continuous crime of sexual abuse while the private prosecution requests 26 years in prison for two crimes of sexual assault and a crime of promoting and facilitating the consumption of toxic drugs that cause serious damage to health.

The Prosecutor’s Office brief indicates that the guard worked the night shift at the Ramón y Cajal Hospital in Madrid on the Psychiatry ward. An 18-year-old girl was admitted by court order since March 28, 2021 for attempted suicide, borderline personality disorder, and eating disorder.

At around one in the morning on April 29, 2021, the accused allegedly took advantage of the fact that the rest of the staff was not in the TEC area at that time and offered her cocaine. “After approaching her, he began to touch her, lifting her shirt, exposing her breasts, touching them while telling her that this has never happened to me before with anyone, you drive me crazy,” the writing says. After that, he continued the sexual assault.

Likewise, the defendant attacked her again on May 1 of that year. Thus, he entered her room and began touching her under her clothes, then sexually assaulting her. The prosecutor emphasises that the victim “injured herself immediately after the events occurred, which also meant, as a result of the above, a significant aggravation of her underlying clinical pathology.”

The prosecutor considers the facts to constitute a continuing crime of sexual abuse, which is why it is appropriate to impose a sentence of 10 years in prison on the defendant, as well as a prohibition on approaching the victim within 500 metres of her home and any place.

The defendant will compensate the injured party in the amount of 20,000 euro for psychological and moral damages, an amount that will accrue the corresponding legal interest. The insurance company must be responsible for this amount as direct civil liability, with the Ministry of Health of the Community of Madrid being subsidiary civil liability.
